GENERAL TERMS AND CONDITIONS

 

By placing your order, you accept the following general terms and conditions of House of Scotland CH GmbH, hereinafter referred to as HoS.

1.    Free exchange and return policy

All products purchased online from HoS can be returned free of charge within 14 days without giving reasons to the following address:

The returned goods must be in a condition that corresponds to the usual use for the purpose of checking the goods - as is customary in a retail store for fitting - and must be provided with an original label. If the goods deteriorate due to further use, we reserve the right to demand compensation for value.

For purchases of 100 CHF or more, HoS delivers free of charge within Switzerland, while stocks last. For purchases under 100 CHF, you pay a flat rate for shipping. Shipping details can be found on the website. It is an estimate. The exact delivery time cannot be guaranteed and varies by carrier.


2. Prices and payment methods

All prices stated at HoS include the statutory value added tax. You can pay for the products of your choice by debit card (Maestro), credit card (Visa, Mastercard, Amex), Twint, Klarna or by PayPal.

HoS is entitled not to accept online orders. Whether an order is accepted is at the discretion of HoS. If an online order cannot be executed by HoS for any reason, HoS will inform the customer immediately.

HoS does not accept orders from customers who have not yet reached the age of 18. An order confirmation does not yet constitute a binding purchase contract. The purchase contract is only concluded upon delivery of the goods. The contract language is German.

To place your binding order via the online shopping cart system, the following steps are required: Please place the selected items in the virtual shopping cart by clicking the 'Add to cart' button. You can open it at any time by clicking on the same button and making changes. After you have placed the desired items in the shopping cart, the shopping cart, by pressing the "Checkout" button, first leads to the selection between the "Log in", "Register now" or "Continue without registration" buttons for entering personal data, or to the login area if you have already registered with us. You then reach the (3) order overview page by selecting (1) the billing & shipping address, the shipping method, the acceptance of our general terms and conditions and (2) the payment method. Here you can check all order data again and, if necessary, make changes or adjustments by pressing the "Change" button or cancel the order (e.g. by closing the browser window). The ordering process is only completed by pressing the "buy now" button. Unless expressly stated otherwise in the item description, all items are delivered without the decoration shown.


3. Damage

If goods are delivered with obvious damage to the packaging or contents, you must, without prejudice to the warranty rights, immediately notify the respective deliverer and refuse acceptance. In addition, you must immediately contact HoS at hello@houseofscotland.ch stating the order number and the transport damage.


4. Ownership

The goods remain the property of HoS until full payment has been made.


5. Right of withdrawal

HoS grants you the right to withdraw from your contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods (or, in the case of separate delivery, the last goods). To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

You can also exercise the right of withdrawal by returning the goods in accordance with section 1 or by returning the goods without comment. Unless the circumstances indicate otherwise, the unremarked return of the goods is considered a declaration of withdrawal.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal or the goods without comment before the expiry of the withdrawal period.

HoS grants you a right of withdrawal of 14 days after you have taken possession of the goods.


6. Consequences of withdrawal

If you withdraw from your contract, we will refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us) without undue delay and at the latest within fourteen days from the day on which we received your notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

The costs of returning the goods are borne by the customer. HOS does not bear any costs for the return. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, properties and functioning of the goods.

With the following sample withdrawal form, we are only fulfilling our legal information obligations. It is not necessary for you to declare the withdrawal to us via the form below. The unremarked return of the goods is sufficient as a declaration of withdrawal.

7. Data protection

All personal data is always treated confidentially.

The personal data collected from you will be processed, used and stored for the purpose of processing and fulfilling your order. Your data may also be transmitted to affiliated companies and/or our service partners and processed and used by them for the purpose of order processing.

The consumer is entitled to a warranty for defects in the purchased item in accordance with the statutory provisions. The customer can in particular demand subsequent performance (new delivery or rectification of defects). However, SE is entitled to refer the customer to a new delivery if the rectification of defects would involve disproportionate effort. Warranty claims expire within the statutory period from delivery of the goods to the buyer. The buyer should assert his warranty claims by stating the order number, his name and address and a brief statement of the reasons. The customer must send the defective goods for inspection at the expense and risk of HoS to the following address:

The content of this website, including texts, graphics, photos, illustrations, images, moving images, sounds and software is protected by copyright. Downloading or use is only permitted for private use. Further publication, transmission, reproduction or other use of the images is prohibited.

By purchasing a gift voucher, you acquire a claim of the same amount against House of Scotland CH GmbH, Torgasse 6, 8001 Zurich, Switzerland, which is embodied by the gift voucher. The claim does not bear interest.

The balance of the gift card can be redeemed in the HoS online shop www.houseofscotland.ch, or in the store at Torgasse 6, 8001 Zurich

The customer's order represents a binding offer to conclude a purchase contract. This offer is accepted with the digital dispatch of the gift card by HoS.

On the website www.houseofscotland.ch you will be guided through a corresponding menu. You can pay for the gift card of your choice by credit card, debit card, Twint, Klarna or PayPal.

If the balance on your gift card is not sufficient to pay for your purchase in full, the difference can be settled with another payment method or another gift card. The balance on this card cannot be exchanged for cash. A remaining balance will not be refunded in cash.

Validity, loss & liability

The gift card is valid indefinitely from the date of issue. The gift card is not personal and transferable. In case of loss, theft or damage, the customer bears this risk. HoS is entitled to pay to the respective holder of the gift card with debt-discharging effect.


11. Severability Clause

Should a provision be or become void or ineffective, the remaining provisions remain valid. Instead of the void or ineffective provision, the relevant legal provisions apply.
